I don't have a scoop, I just have a good memory and terrible sources. Let's just say that of the 23,000+ renditees that are "admitted" to be in the system, all should have video tape, whether analog or digital. If digital..the backup is always on the same servers in Germany where Bush/Rove are storing the "erased" 3.1 million emails that show just where White House takes it orders from. But, if we all put our thinking caps on we should be able to "cipher" WHOSE image would have appeared!
I handled a missing audio "tape" case once. Seems the "Attorney General" of a particular state, told me that the "tape" of an "administrative hearing" containing an admission, under oath, by the State's Director of Workers Comp , that the State system in question was out of compliance with Federal Requirements, was lost.
Zorro was selfishly using the "admission" to jawbone the AG to shut down the entire Worker's Comp system of the state...so the entire State would have to shut down. Why? Without a functioning Worker's Comp system for State Employees, no state may continue to operate. Upon my motion, the appeals court issued a "Writ of Mandamus" ordering the AG to make the tape or a summary available...and acknowledging the risk to the State function.
Once the AG knew he'd been "out-matched" by a 26 year old "sole practitioner", practicing his first administrative appeal, the AG was forced to provide a "written summary" of precisely "one-half" of the tape, claiming the other "half" of the tape had been lost. He didn't even bother to claim it had been erased, he just claimed 1/2 had been lost.
Once I realized the AG was "playing magic mind games" with the 1/2 of the tape that would shut down the state, I figured he must be ready to "deal".
I saw the "invisible" hand writing on the "invisible" black board. You know what the "invisible" writing said! ", you've caught us red=handed! we're ready to deal! Make us an offer!" (he took my first offer!)
Dear US Senate...you don't need hearings. The CIA wants to make you a deal. The Tapes they "destroyed" isn't likely to be a "complete tape" it's just the part that contains the interrogation by one interrogator. They want to give you somebody, I hope you're listening and in a negotiating position. Hear that Jay Rockefeller..."It's Deal Or No Deal!"
We all need to read between the lines on the fact that the CIA ONLY disposed of two analog/or digital tapes, containing about 18 minutes out of 467,366 hours of interrogations. In other words, only 18 minutes out of 2 million minutes. Are they are ONLY tapes worth protecting the id of two specific "interrogators". I say they sitting on Deutche Bank's servers, along with Hitler's "real" Death Certificate. I wonder if the "detainees" may have drowned?
Which Two? One of my first lessons in studying ancient legal systems was the concept of the "vow"...ie the "ancient oath" such as "so help me, God". the "vouch-safe"...the "sworn" testimony. The "eye witness".
The cool thing about ancient legal jurisprudence, even in the middle of the dark ages, courts preferred "vouched" witnesses and "vouch-safed" testimony or "Sworn" testimony as in an oath.. ! In those days the Jury were also the witnesses. The "compurgers" (from English Root for "perjury" or oath-breaker) were people who swore to the "trust worthiness" of the Witnesses. Under Church regulations, different crimes required a specific number of witnesses for conviction...and a specific number of "co-swearers" to prove innocence.
Even in the days of early Christian trials, TORTURE was a "punishment"..it was never a "pentathol substitute"! In fact, in most courts, tribal or royal, throughout the entire planet, since the days of the "Hittites" "torture" was used as a "punishment" not an "evidence-seeking" strategem.
Legal Oaths are as old communication itself. They are as old as the law..and as old as justice. In fact, they've become "rote". A "meme-omatic" response of the autonomic nervous system when someone appears not to believe what we say. We instinctively "mumble"..., "I swear, it's the truth".
I remember something Bush said in a QA in the White House briefing room. A reporter had challenged Bush on claiming that the US does NOT use torture. Several question were quite pointed and then Bush made his response. It may have been "off the cuff" but probably scripted. He said something like this.
"Listen, I can "vouch" for the...(looking toward Rumsfeld)..Secretary Rumsfeld....er we...well..we can (Rumsfeld began nodding at the President)..vouch for the fact that what is happening to these people, these terrorists, these people , is NOT Torture. It's rough work, but it's not torture. And the people who are doing this job are true patriots."
Now, I'm not going to go to the trouble to review my tapes. But someone out there (CNN) probably has it recorded. "Vouched" for means he is a "witness". He swears! He is an eye-witness. He is a "participant".
Bush was there during at least ONE "torture session". So was Rumsfeld. I'll bet the tapes of those sessions are gone to "protect the identity of the interrogator. The interrogator is a person's whose identity would be compromised".
Which session? What month? zorro's just a big mouth..not a spy!
